Seriously Scans

Effective date: [DATE — set at publication] · DRAFT for PM and attorney review — not yet in force

1. What Seriously Scans is

Seriously Scans prepares eBay listing drafts from photographs you take of your own comic books. Drafts are created for review; when you choose to publish one, the listing is created on your own eBay account, under your seller name. Seriously Scans is a preparation tool, not a marketplace, an auctioneer, or an agent.

2. You are the seller

Every listing you publish is yours: your item, your seller account, your listing, subject to eBay's rules and your agreements with eBay. You are responsible for the accuracy of your listings — including condition and grading claims, descriptions, photographs, pricing, shipping, returns and any disputes with buyers.

These are not just promises — they are how the software is built:

3. Beta service

Seriously Scans is in an invite-only beta. The service is provided as is and as available: features may change or be withdrawn, there is no uptime guarantee, and access may be ended at Seriously Brands' discretion. Any pricing shown during the beta is beta pricing and may change with notice.

4. Accounts and access

Using Seriously Scans requires a Google account (your photos are stored in your own Google Drive) and, to publish, a connection to your own eBay account. You may disconnect either at any time from the app's settings. Disconnecting Google stops the service from reading new photos; disconnecting eBay stops pushing and publishing. Existing drafts remain in your account until you delete your account; live eBay listings are unaffected by disconnecting and are managed in your eBay account.

5. Your photos and data

Your photographs live in your own Google Drive — the service sees only the folders it creates or that you explicitly choose, and we do not keep copies of them after processing. One narrow exception: corner close-ups cut from a book's front and back shots are kept on our server so you can choose to include them in a listing. They are derived images, clearly marked as such, never used for identification, never written back to your Drive, and kept until you delete your account. The full picture, including our commitments about pricing data, is in the Privacy Policy, which is part of these terms.

6. Payment (not yet in effect — no charge during the beta unless stated in the app)

When paid subscriptions begin: billing is by subscription through our payment processor, on a monthly term that renews until cancelled. Cancellation takes effect at the end of the current billing period. Fees for partial periods are not refunded, except where Seriously Brands chooses to make an exception or where the law requires one. Prices may change with notice effective from your next billing period.

7. Acceptable use

Violations may end your access under section 3.

8. Relationship to eBay and Google

Seriously Scans is operated by Seriously Brands LLC. Not affiliated with or endorsed by eBay Inc. "eBay" is a trademark of eBay Inc.; "Google" and "Google Drive" are trademarks of Google LLC. Your use of eBay and Google through the service is governed by their own terms.

9. Liability and indemnity

To the maximum extent permitted by law, Seriously Brands LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from the service; and its total liability for any claim is limited to the amounts you paid for the service in the twelve months before the claim (or $50 if you have paid nothing). You agree to indemnify Seriously Brands LLC against claims arising from your listings, your items, or your breach of these terms.

10. Governing law

These terms are governed by the laws of [STATE — to be confirmed by Seriously Brands LLC], and disputes belong to the state or federal courts of that state, except where the law of your residence requires otherwise.

11. Changes to these terms

We may update these terms; material changes will be announced in the app or by email, with the new effective date shown at the top of this page. Continuing to use the service after the effective date is acceptance of the updated terms.
